PARTICIPATION AGREEMENT, LIABILITY RELEASE & ASSUMPTION OF RISK (NEW YORK):
In consideration for membership, event registration, and participation in activities, playdates, and gatherings organized by My Favorite Play Group / Playdate Society (“the Organization”), I, the undersigned parent/legal guardian, agree to the following terms on behalf of myself, my minor child(ren), and our heirs/estate:
1. Assumption of Inherent Risks: I acknowledge that children's recreational play, sensory activities, arts and crafts, outdoor games, and group gatherings carry inherent risks, including but not limited to physical scrapes, falls, collisions, allergic reactions, exposure to communicable illnesses, and property loss. I certify that my child is physically able to participate and voluntarily assume all ordinary risks associated with attendance.
2. Parental / Caregiver Supervision: I understand that events are cooperative community gatherings and not licensed childcare, daycare, or drop-off services. A designated parent, legal guardian, or authorized adult caregiver (18+) must remain on-premises and actively supervise registered child(ren) at all times.
3. Release and Covenant Not to Sue (State of New York): To the fullest extent permitted under the laws of the State of New York, I hereby release, waive, discharge, and hold harmless the Organization, its founders, event hosts, volunteers, members, and the owners/lessors of the premises utilized, from any claims, causes of action, or demands arising out of ordinary negligence during scheduled events. This release does not extend to gross negligence, willful misconduct, or intentional harm.
4. Non-Refundable Membership Fees: All periodic membership dues, subscription payments, and registration fees are strictly non-refundable once processed. Dues maintain platform access and group coordination; refunds or credits will not be issued for missed events, weather-related cancellations, illness, or early membership termination.
5. Emergency Medical Care & Expenses: If I am temporarily incapacitated or unreachable during an acute medical emergency, I authorize event organizers to contact emergency medical personnel (EMS/911). I accept full financial responsibility for all medical transport, examination, and treatment costs incurred.
6. Photo / Media Notice (Optional/Revocable): I acknowledge that group photos may occasionally be captured during public/community gatherings. I retain the right to notify event organizers in writing if I request my family's exclusion from social/promotional media.
7. Governing Law & Severability: This agreement is governed by and construed in accordance with the laws of the State of New York. If any provision is deemed invalid or unenforceable, all remaining provisions shall continue in full force and effect.
